Decision No D. 400/36/2025 by the Public Procurement Arbitration Board

After its public procurement contract concluded on the basis of the public procurement procedure titled “Szigetvár Recreational Centre 2” had failed to come into effect, the Municipality of Szigetvár launched and conducted a new public procurement procedure in respect of which the Public Procurement Arbitration Board (hereinafter: PPAB) found, based on the ex officio initiative submitted by the Integrity Authority, that the contracting authority, the successful tenderer and another tenderer had all committed infringements and imposed fines on them.

As in other public procurement procedures, based on the cumulative examination of the evidence, the circumstances surrounding the submission of tenders, the tendering declarations and tender metadata, the PPAB established that the same tenderers had repeatedly violated fair competition required under Section 2(1) of Act CXLIII of 2015 on public procurement. Consequently, the contracting authority should have declared their tenders invalid and the public procurement procedure unsuccessful.

A request for judicial review has been submitted against Decision No D. 400/36/2025 of the PPAB.    

The PPAB combined case No D.399/2025, launched upon the initiative of the Integrity Authority, with case No D.400/2025. In both cases, a consolidated decision was made as described above.
